In a notable development, the bench led by Chief Justice of India DY Chandrachud has announced that it will no longer hear petitions challenging the immunity granted to husbands in marital rape cases. This decision comes as Chief Justice Chandrachud is set to retire on November 10, preventing the current bench from delivering a verdict before that date.
The bench, which also includes Justice JB Pardiwala and Justice Manoj Misra, has adjourned the matter for four weeks, at which point a new bench will take over the hearings.
During the recent proceedings, lawyers representing various parties indicated that they would require additional time for their submissions. Senior Advocate Sankarnarayanan noted that he would need at least a day to complete his arguments. Solicitor General Tushar Mehta and Senior Advocate Rakesh Dwivedi echoed this sentiment, also requesting a full day for their submissions. Other legal representatives, including Maninder Singh, Arvind Datar, and Indira Jaising, are also involved in the case.
Recognizing the complexity of the situation, Chief Justice Chandrachud remarked, “Then this can be deferred.” He elaborated on the timeline needed for arguments from all parties, indicating that with the required submissions from various counsels, it would be impossible to conclude the hearings in the near future. As a result, he ordered the matter to be relisted for further consideration.
